Small Claims Court

 

What to do if you are suing, or are being sued, for money or the return of personal property valued at $25,000 or less.

To sue a person or business in small claims court, your lawsuit, called a claim, must fall into one of the two following categories:

​

  1. Claims for money owed under an agreement, such as,

    • unpaid accounts for goods or services sold and delivered

    • unpaid loans

    • unpaid rent

    • NSF (non-sufficient funds) cheques
       

  2. Claims for damages, such as,

    • property damage

    • clothes damaged by a dry cleaner

    • personal injuries

    • breach of contract

Superior Court of Justice

 

If you want to sue for more than $25,000, you will have to take your case to the Superior Court of Justice (“civil court”).


​​The Superior Court of Justice is one of the busiest trial courts in the world. The Court has jurisdiction over criminalcivil, and family cases, and is the largest superior trial court in Canada. The Divisional CourtSmall Claims Court, and Family Court are all branches of the Superior Court of Justice.

Wills, Estates & Trusts

 

Estate planning involves the transfer of someone's assets (e.g. property, money) when they die, as well as a variety of other personal matters. Wills, estates, trusts and power of attorney are all common tools used in estate planning. This section also contains information about family members who can't take care of themselves.

UPDATE: Changes to Estate Rules

Starting January 1, 2016 a "proof of death" (documented evidence of a person's death) needs to be filed when applying for a certificate of appointment of estate trustee with or without a will.

This includes:

  • a death certificate issued by the Registrar General

  • a Funeral Director's proof of death certificate, or

  • an order made under the Declarations of Death Act, 2002 declaring that the person has died

Our specialties are Commercial Rent Collections, Appraisals, Bailiff Seizures under the General Security Agreement, Lease Agreement, Personal Property Security Act, Repair and Storage Lien Act and we also take care of all of your Process Serving needs.

We also provide services under the Commercial Landlord and Tenant Act;Appraisals, Liquidation and Auction Sales; Recovery of Equipment; Seizure of Inventory under the General Security Agreement; and Searches under P.P.S.A., R.S.L.A and P.S.T. 

Accident Benefits Claims

 

If you have been injured in a car accident, you may be entitled to certain financial benefits which will assist you while you are recovering. Statutory Accident Benefits Schedule (or SABS) is provincial regulation of benefits which are standardized among insurance companies. Statutory Accident Benefits provide compensation, regardless of fault, if you, your passengers, or pedestrians suffer injury in an automobile accident.

Even though you have reported your car accident and damages to your property (vehicle and etc), if you are injured, you must report your injuries to your insurance company as well. Claiming accident benefits and claiming restitution for damages to personal property are two separate endeavors.

Motor Vehicle Accidents

 

If you have been injured in a car accident, there are certain things you must be aware of in proceeding with an insurance claim in Ontario.
